Terms of Service

Welcome to CaloPilot. These Terms of Service govern your access to and use of the CaloPilot mobile app, website, onboarding flow, nutrition tools, meal-planning features, AI-assisted features, content, and related services. They form a legally binding agreement between you and CaloPilot.

In these Terms, 'CaloPilot', 'we', 'our', or 'us' means the CaloPilot app and its operators. 'You' means the person using the service or, where required by local law, a parent or legal guardian acting on that person's behalf.

For purposes of these Terms, 'Content' includes text, comments, recipes, meal plans, workouts, images, graphics, audio, video, software, data, nutrition information, food information, designs, trademarks, and other material made available on or through CaloPilot. 'User Generated Content' means content that you or another user submit, upload, create, or otherwise make available through the service. 'Services' means the features, tools, applications, and websites that CaloPilot makes available. 'Site' means CaloPilot websites, subdomains, and mobile applications.

To the fullest extent permitted by law, your use of CaloPilot and any linked services is at your own risk. The service is provided on an 'as is' and 'as available' basis, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, security, accuracy, completeness, or uninterrupted availability.

You acknowledge that nutrition data, planner suggestions, food information, AI-assisted results, and other content are provided for informational purposes only. You are solely responsible for evaluating whether any information, recommendation, estimate, or plan is accurate, complete, and appropriate for your needs before relying on it.

Online services involve inherent risks, including errors, interruptions, outdated data, third-party dependencies, user-generated content issues, and connectivity failures. By using CaloPilot, you voluntarily assume those risks.

CaloPilot does not provide medical, healthcare, or professional advice. You should consult a qualified healthcare professional before making medical, nutritional, or treatment decisions based on the service.

CaloPilot may include third-party links, content, integrations, professionals, coaches, or advisor-facing features. We do not control or endorse third-party services or the qualifications, advice, or conduct of any professional or coach using the platform.

If you interact with a coach, professional, advisor, or third-party service through CaloPilot, that relationship is solely between you and that third party. CaloPilot is not responsible for advice, guidance, services, errors, omissions, or claims arising from those interactions.

If you use a professional or coach account, or any client-management feature that CaloPilot makes available, you act as an independent user and not as an employee, agent, or representative of CaloPilot. You are solely responsible for your interactions with your clients, your staff, your permissions, and your compliance with applicable law.

By accessing or using CaloPilot, you acknowledge that you have read and understood these Terms, that you understand the limitations of the service, and that you accept these Terms voluntarily.

These disclaimers and acknowledgements continue to apply to the maximum extent permitted by law even after you stop using the service.

CaloPilot is not intended for children under 13 years old. If you are under the age of majority in your local jurisdiction, you may use CaloPilot only with the permission and supervision required by applicable law.

If a parent or legal guardian permits a minor to use CaloPilot, that parent or guardian is responsible for the minor's compliance with these Terms and for the minor's use of the service.

By creating an account, submitting information, clicking an acceptance button, downloading or using the app, or otherwise accessing CaloPilot, you agree to these Terms and to the CaloPilot Privacy Policy.

We may revise these Terms from time to time. When we make material changes, we may provide notice in the app, on the website, by email, or by another reasonable method. By continuing to use CaloPilot after revised Terms take effect, you agree to the updated Terms.

You are responsible for obtaining and maintaining the devices, software, browser versions, operating systems, internet access, mobile data service, third-party accounts, and other connectivity needed to access CaloPilot.

You are also responsible for any fees charged by your internet provider, wireless carrier, app store, payment processor, or other third party in connection with your use of the service.

You may use CaloPilot only for lawful purposes and only in compliance with these Terms. You may not misuse the service, interfere with other users, scrape protected data, reverse engineer restricted parts of the app, bypass security controls, or use CaloPilot for unauthorized commercial purposes.

You remain responsible for the information you enter into CaloPilot, including food logs, body measurements, meal plans, photos, preferences, messages, and other user-submitted content.

If CaloPilot offers professional, coach, or advisor features, those features may be used only within the scope permitted by the product and by applicable law. You may not resell access to CaloPilot or export client data outside the permitted service context without authorization.

To use certain features, you may need to create an account and provide accurate, current, and complete information, including your email address and other registration details. You agree to keep that information updated.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us promptly if you suspect unauthorized use of your account or a security breach.

CaloPilot uses commercially reasonable measures to protect accounts and user content, but we cannot guarantee that unauthorized parties will never defeat those protections. For your protection, you should sign out after using shared or public devices.

Your username or profile identifier may be visible in some parts of the service. You should avoid selecting a username that discloses sensitive personal information.

We may reject, remove, or require changes to any username or profile identifier that is misleading, impersonates another person or entity, infringes rights, or is offensive or otherwise inappropriate.

Each time you access your account, you represent that you are authorized to use that account, that your registration information remains current and accurate, and that you are using the service for lawful purposes in compliance with these Terms.

You also represent that you are not using CaloPilot on behalf of a competitor for the purpose of copying, disputing, or undermining the service, and that you are not using it for spam, solicitation, harassment, or unlawful commercial outreach.

CaloPilot is continually evolving. We may add, modify, patch, limit, suspend, or discontinue parts of the service, features, content, pricing, or availability at any time, with or without notice, to the extent permitted by law.

You may need to install updates, use newer device software, or accept changes to continue using some features. We are not obligated to maintain any particular feature, integration, or version of the service for any specific period of time.

You retain responsibility for the User Generated Content that you submit or make available through CaloPilot. You represent that you have the rights needed to submit that content and that it does not violate law or the rights of another person.

By submitting User Generated Content to CaloPilot, you grant us a non-exclusive, worldwide, royalty-free license to host, store, process, reproduce, adapt, display, and use that content as needed to operate, improve, secure, and support the service, subject to our Privacy Policy.

We may suspend, restrict, or terminate access to CaloPilot if we believe you have violated these Terms, created risk for the service or other users, failed to pay applicable fees, or used the service in a way that may be unlawful, abusive, or harmful.

You may stop using CaloPilot at any time. Certain provisions of these Terms, including disclaimers, limitations of responsibility, payment obligations, content rights, and dispute-related provisions, will continue to apply after your use ends where legally permitted.

We may update these Terms of Service from time to time. When we make material updates, we may notify you inside the app, on the website, by email, or through another reasonable method.

By continuing to use CaloPilot after updated terms take effect, you agree to the revised terms.
